The BioCollective (“BioCollective”) understands how important the privacy of Personal Data is to our users. This Privacy Policy will tell you what information we collect about you and about your use of the BioCollective website found at (“The BioCollective Site”) or any other mobile or web services owned, controlled, or offered and provided by The BioCollective (collectively, the “BioCollective Service”).

We have prepared this Privacy Policy to describe to you our practices regarding the Personal Data we collect from users of The BioCollective Service. If you choose to register with The BioCollective, update an existing member profile, make a purchase through our website, sign up for our newsletter, respond to a survey or marketing communication, surf the website, use certain other site features or access certain functionality of The BioCollective Service, you may be required to submit Personal Data. “Personal Data” includes data that allows someone to identify or contact you, including, for example, your name, address, telephone number, e-mail address, date of birth, and device identifier as well as any other non-public information about you that is associated with or linked to any of the foregoing data. In addition, our interactive tools and services may require you to submit protected health information (PHI), which would also be considered Personal Data. It is always your choice whether or not to provide us with such information. However, if you choose not to provide the requested information you may not be able to participate in The BioCollective or access certain features or functions of The BioCollective Service.

“Anonymous Data” means data that is not associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons. We collect Personal Data and Anonymous Data as described below. You are responsible for ensuring the accuracy of the Personal Data that you submit to The BioCollective. Inaccurate information will affect your experience when using The BioCollective Service.

By signing the required informed consent form provided at the time of registration and using The BioCollective Service, you accept and hereby expressly consent to the terms of this Privacy Policy. This Privacy Policy may change from time to time, so please check back periodically to check the most recent modification date to ensure that you are aware of any changes. Your continued use of The BioCollective Service after any such changes signifies your express consent to such changes. If you do not want your Personal Data used by BioCollective as provided in the informed consent form and this Privacy Policy, you should not register as a member of The BioCollective or for any specific tool or application that collects Personal Data.

Neither The BioCollective nor any of its Services are designed for, intended to attract, or directed toward children under the age of 13. A parent or guardian, however, may collect a stool sample from, create an account for, and provide information related to, his or her child. The parent or guardian assumes full responsibility for ensuring that the information that he/she provides to The BioCollective about his or her child is kept secure and that the information submitted is accurate. If we become aware that a person under 13 has provided Personal Data without consent from a parent/guardian, The BioCollective will take steps to remove such information and terminate that individual’s account, access and use of The BioCollective Service. Given that the Internet operates in a global environment and that transfer of your Personal Data is necessary to process your registration and use The BioCollective Service, to provide updates, and to respond to your inquiries, using the Internet to collect and process Personal Data necessarily involves the transmission of data on an international, or cross-border, basis. By registering for or using The BioCollective Service, and/or by communicating with us via our website or by email, you acknowledge and expressly consent to our processing and disclosure of your Personal Data in this way. The Personal Data of users who are located outside the U.S. will be transferred outside of each eligible country to the United States where our servers are located and where it will be processed and stored on servers in the U.S. We will take all steps reasonably necessary to ensure that users’ Personal Data is treated securely with respect to such transfer, but will not otherwise take steps to ensure compliance with applicable laws in each user’s country of residence.





Whenever you visit The Biocollective Site, or access The BioCollective Services, we receive and record information on our server logs from your browser, including your IP address, The BioCollective’s cookie information, and the pages you request, and relate it to the Personal Data you provide.

The BioCollective collects and uses information you provide to:

Provide, analyze and improve The BioCollective’s products and services to you; communicate with you about our products and services or to reply to your request for information or comments; with your consent, provide information to you about developments, announcements, promotions or new products or services; conduct research, the results of which could be used to develop therapeutics ; if applicable, provide information to and receive information from third party vendor(s) for purposes of provisioning and arranging shipment of your supplies (e.g. stool sample kits); with your consent, provide information to your health plan provider related to The BioCollective programs; provide de-identified reporting (i.e. reporting that does not contain any PHI) for internal and external clients and associated partners. Cookies/Google. Our Site uses a software technology called "cookies." Cookies are small text files that we place in visitors' computer browsers to store their preferences. Cookies themselves do not contain any Personal Data. sGoogle, as a third-party vendor, uses cookies to provide advertisements on the BioCollective Site. Google's use of the DART cookie enables it to provide ads to our users based on previous visits to our Site and other sites on the Internet. Users may opt-out of the use of the DART cookie by visiting the Google Ad and Content Network privacy policy.

Opting out of Google. You can set preferences for how Google advertises to you by using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising Initiative opt-out page or permanently using the Google Analytics Opt-Out Browser add on.

Web Beacons. "Web beacons" are small pieces of code placed on a web page to monitor the behavior and collect data about the visitors viewing a web page. For example, web beacons can be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page. We may use web beacons on our Site from time to time for this purpose.

Profile. We may collect Personal Data from you, such as your name, address, ethnicity, age, gender, date of birth, email address, and password for The BioCollective Services, and any other information you voluntarily add to your profile on the BioCollective Site, app or information that is generated by your use of The BioCollective Service (“Profile Information”).

Account Information. We may require you to provide an email address and password to use all features of The BioCollective Services (“Account Information”). You may change the email address and password associated with the account according to the methods provided by The BioCollective Services.

Feedback/Support. If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply. If you contact us for support, we may also collect and retain certain technical diagnostic data, e.g., the make and model of your phone.

Mailing List. If you provide us your email address for inclusion in our mailing lists, we will collect your email address. We may email you news about The BioCollective, The Biocollective Services updates, the latest information on products and services, and third party offers that apply to you. You may opt out of such emails, other than emails related to the operation of The Biocollective Services, at the time of registration, and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mails you receive. You may not opt out of emails related to the operation of the BioCollective Services, as these may be necessary for the normal operation of The BioCollective Services, such as password recovery, or for your full enjoyment of The BioCollective Services.

Purchases. If you make any purchases from us, we will collect all information necessary to complete the transaction, including your name, credit card information, billing information, address, telephone number, and email address. If we use a third party service provider, the service provider may provide certain information back to us (e.g., your name, phone number, partial credit card number, and email address).

Other. We may also collect Personal Data at other points in The BioCollective Service that state that Personal Data is being collected. The BioCollective will retain Profile Information on the servers for The BioCollective Service for as long as needed to provide The BioCollective Service and to comply with our legal obligations, resolve disputes and enforce our agreements.




By agreeing to our Privacy Statement and Terms and completing the Informed Consent Form provided at the time of registration, you consent to sensitive information, including, but not limited to information you provide us about your physical or mental health, genetic information, racial and ethnic origin, age and sexual orientation (where you provide it) (“Sensitive Information”) being used by us to:

analyze and provide you with our Services; analyze and provide you with information about your ancestry; determine whether you would be suitable to take part in surveys, polls or questionnaires that we are conducting; and monitor and improve existing products or services that we offer or develop new products and services We will not use your Sensitive Information without your consent unless: (i) the information has been anonymized or aggregated so that you cannot reasonably be identified as an individual; or (ii) a legal obligation requires us to use it in some way e.g. a court order requires us to disclose the information.




The BioCollective does not rent, sell, or share your Personal Data with other individuals or nonaffiliated companies for purposes not related to The BioCollective Services provided except to share, disclose or transfer your Personal Data when we have your consent to share such information, when we provide Personal Data to third parties working on our behalf to provide Services that you request (as more fully described below), or to third parties under confidentiality agreements with us.

We use your Personal Data in the following ways and as described elsewhere in this Privacy Policy: (a) to identify you as a user on The BioCollective Service; (b) to improve The BioCollective Service; (c) to provide the services you request, including The BioCollective Service; (d) to respond to your inquiries related to support, or other requests.

Third Party Service Providers. We may share your Personal Data with third party service providers to: provide you with The BioCollective Services; to conduct quality assurance testing; to provide technical support; and/or to provide other services to The BioCollective. Except as otherwise stated in this Privacy Policy,. These third party service providers are required by contract not to use your Personal Data other than to provide the services requested by The BioCollective. .

Third Party Websites and Tracking. The BioCollective Service may contain links to third party websites. The fact that The BioCollective has provided a link to a website is not an endorsement, authorization, sponsorship or acknowledgment of affiliation with respect to such website, or with respect to any products, services, information or content on such website. When you click on a link to any other website or location, you will leave The BioCollective Site and go to another site and another entity may collect Personal Data or Anonymous Data from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites. Not all third-websites allow you to opt out of their tracking and analytics. Because The BioCollective relies on third party ad networks that may track you across websites over time for advertising purposes, we are not able to respond to your selection of the "Do Not Track" option provided by your browser. We cannot advise on whether your selection of "Do Not Track" option will have any effect on the collection of cookie information by the third parties who collect such cookie information on our site.

Other Disclosures. Regardless of any choices you make regarding your Personal Data (as described below), The BioCollective may disclose Personal Data in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws; to establish or exercise our rights to defend against legal claims; if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, safety of person or property, violation of our policies, or as otherwise required by law.

Your Choices Regarding Your Personal Data; Changing Your Personal Data.

California Privacy Rights. If you are a California resident, California Civil Code Section 1798.83(the "Shine the Light" law) permits you to request and obtain from us once a year, free of charge, information about the Personal Data (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. If you do not want your name and contact information to be shared with any company or organization, you may notify us at any time by emailing us at or our regular mailing address below.

Changes to your Personal Data. You may change certain fields of your Profile Information by editing your profile on The BioCollective Site or in The BioCollective App. You may request deletion of your Personal Data by us, but please note that we may be legally required to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives. We may keep your Personal Data, Distance Information, Device ID, hashed Device ID, and your usage history (which includes a history of text or photos that have been censored, bans, as well as a history of profile photos uploaded) for administrative purposes.

Security of Your Personal Data. The BioCollective is committed to protecting the security of your Personal Data from unauthorized access, use, or disclosure. We use a variety of industry-standard security technologies and procedures to help protect your Personal Data from unauthorized access, use, or disclosure. However, no method of transmission over the Internet, or method of electronic storage, is 100 percent secure. Therefore, while The BioCollective uses reasonable efforts to protect your Personal Data from unauthorized access, use, or disclosure, The BioCollective cannot guarantee its absolute security.

Access to your Personal Data. You may access, review, change, update or delete to your Personal Data and request information about our collection, use and disclosure of such information by contacting us at or 720.295.2027 You may also withdraw your consent by emailing us to do so, to the extent permitted by applicable law. If you wish to unsubscribe from any of our emails, please click on the “unsubscribe” feature on the email you receive from us.

Recruiting for external research. Academic institutions, healthcare organizations, and other groups are always conducting interesting new research projects. We want to make you aware of these opportunities. While we do not share Personal Data with third parties without your consent, from time to time we may inform you of third-party research opportunities for which you may be eligible. For example, if a university tells us about a new research project, we may send an email to The BioCollective members who potentially fit the relevant eligibility criteria based on the self-reported Personal Data to make them aware of the research project and provide a link to participate with the research organization conducting the study. If you do not wish to receive these alerts, you can manage your settings so you do not receive such communications.

Opt-Out Options. You may opt-out of receiving future messages and announcements from The BioCollective and remove your name from our mailing lists. The opt-out provisions do not apply to information collected by cookies or used internally to recognize you and/or facilitate your visits to The BioCollective Site, or information we may retain to comply with legal requirements.

Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without giving effect to any principles of conflicts of law.

Jurisdiction. Except as set forth in the Terms and Conditions, you agree that any action at law or in equity arising out of or relating to this Agreement or the Service shall be filed only in the state or federal courts in the State of Colorado and you hereby consent and submit exclusively to the personal jurisdiction of such courts for the purposes of litigating any such action. Nothing in this Agreement shall prevent The BioCollective from seeking injunctive relief in a court of competent jurisdiction.

Changes to This Privacy Policy. We can change, modify, add, or remove portions of this Agreement at any time by sending an e-mail to the last e-mail address you provided to us (if any) and/or by prominently posting notice of the changes on The BioCollective website or Service. Please check this Agreement periodically for changes. You are responsible for providing your most current e-mail address. If the last e-mail address you provided us is not valid, or is not able to deliver to you the notice described above, sending the e-mail is still effective notice. If you continue to use The Biocollective Site or Service after we send you an e-mail notice or post modifications or changes on The Biocollective Site or Service, this constitutes your binding acceptance of the changes. For any material changes to this Agreement, you acknowledge and agree that those amended or modified terms are automatically effective thirty (30) days after we send you an e-mail notice or thirty (30) days after they are first posted on The BioCollective Site or The BioCollective Service. These changes will be effective immediately for new Users of The BioCollective Site or The BioCollective Service.
